Terms of service
Last updated: 27 October 2026
1. About these terms
These terms apply to the Marelia website, the Marelia web platform and the Marelia desktop application (together, "Marelia"), provided by HIDROCIBALAE d.o.o., Jurja Dalmatinca 33, 32100 Vinkovci, Croatia, OIB 38874770240 ("Hidrocibalae", "we").
Marelia is sold to businesses. By using it you confirm that you do so on behalf of an organisation and that you may accept these terms for it. If your organisation has signed a separate agreement or order with us, that agreement takes precedence over these terms where the two differ.
2. Accounts
- Accounts are created by us or by your organisation's administrator. Each account is personal; do not share sign-in details.
- Keep your password safe and tell us straight away at hello@marelia.eu if you think someone else has used your account.
- Your organisation is responsible for what happens under its users' accounts and for removing users who should no longer have access.
3. Licences and seats
Your organisation buys licences for one or more Marelia modules for a set period. Each licence comes with a number of seats. Marelia may be installed on any number of computers, but the number of computers using a module at the same time cannot exceed the number of seats. A seat is released when the application signs out, and automatically after a period without activity.
Trial and demo licences are for evaluation only, are limited in time, and may have reduced functionality, as described in the offer.
Licences are granted to your organisation and may not be transferred, resold or sublicensed without our written consent.
4. Acceptable use
You must not:
- get around licence, seat or security controls, or help anyone else do so;
- copy, decompile or reverse engineer the software, except where the law expressly allows it;
- use Marelia for anything unlawful, or in a way that harms our systems or other customers;
- probe, scan or load test the platform without our written permission.
We may suspend access if these rules are broken. Where we can, we will warn you first.
5. Fees and payment
Fees are as set out in your order or offer and are invoiced in advance for each licence period unless agreed otherwise. Prices exclude VAT. Late payments accrue statutory default interest under Croatian law. If an invoice remains unpaid 30 days after a written reminder, we may suspend the licence until it is paid.
6. Your data
Your survey data, project files and results belong to you. Marelia processes them on your own computers and does not send them to us. Account, device and usage data that we do receive is handled as described in our privacy policy. Your organisation can switch off usage reporting at any time.
7. Our intellectual property
Marelia, including its software, tools, documentation and brand, belongs to Hidrocibalae or its licensors. A licence gives your organisation the right to use Marelia during the licence period and nothing more. If you send us feedback or suggestions, we may use them freely.
8. Availability and support
We work to keep the platform available and to fix problems quickly, but we do not guarantee uninterrupted service unless a service level is agreed in your order. We may carry out maintenance, and we will announce planned downtime in advance where we can. Support is available at hello@marelia.eu.
9. Professional judgement
Marelia automates parts of geophysical data processing and quality control. Its results are an aid to qualified professionals, not a replacement for them. You remain responsible for checking results before they are used in deliverables, engineering decisions or navigation.
10. Liability
Apart from what is expressly stated in these terms or in your order, Marelia is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit, lost data or project delays, and our total liability in any 12-month period is limited to the fees your organisation paid for Marelia in that period.
None of this limits liability for damage caused intentionally or through gross negligence, or any other liability that cannot be limited under Croatian law.
11. Ending the agreement
Licences end at the end of their period unless renewed. Either side may end the agreement early if the other materially breaches it and does not fix the breach within 30 days of written notice. When a licence ends, access to the affected modules stops. Results you have already produced remain yours.
12. Changes to these terms
We may update these terms. We will tell account holders about significant changes by email at least 30 days before they apply. Continuing to use Marelia after that means accepting the new terms.
13. Law and disputes
These terms are governed by the laws of the Republic of Croatia. Disputes fall under the jurisdiction of the competent court in Vinkovci, unless mandatory law provides otherwise. Before going to court, please write to us at hello@marelia.eu; we will reply within 15 days and try to sort it out.
